2. User Accounts
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.
- You must provide accurate, current, and complete information during registration.
- You must not use the account of another user at any time.
- You must notify us immediately of any unauthorized use of your account.
3. Description of Service
EMI Locker provides a software platform that allows users to link financial accounts and enter into agreements to protect against interest rate fluctuations.
Important: EMI Locker is not a bank or a financial institution. We do not lend money. We provide a hedging mechanism.
- We facilitate connection to banks via secure third-party APIs (OAuth 2.0).
- We provide market analysis and rate locking tools.
- We reserve the right to refuse service to anyone for any reason at any time.
4. Fees and Payment
Certain services offered by EMI Locker are fee-based. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.
Our current fees are outlined on the Pricing Page. We reserve the right to change our prices at any time. However, any price changes will apply prospectively.
You agree to pay all charges incurred under your account at the prices in effect when such charges are incurred.
5. Financial Disclaimer (Important)
Risk of Loss: Locking an EMI rate involves financial risk. If market interest rates drop significantly below your locked rate, you may be paying more than the prevailing market rate. We are not responsible for market movements.
6. Termination
You may terminate your account at any time by following the instructions on the "Settings" page within the Service. Upon termination, your right to use the Service will immediately cease.
We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason whatsoever and without limitation.
7. Limitation of Liability
To the fullest extent permitted by applicable law, EMI Locker, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for:
- Any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind.
- Any direct, indirect, incidental, special, consequential or exemplary damages, arising out of or in connection with your use of the service.
- Losses caused by third-party service providers (e.g., your bank, data aggregators).
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
